Dene Tha and Mackenzie County at impasse concerning winter access roads

An interim agreement has paused plans to open winter access roads in northwestern Alberta, as a legal dispute unfolds between Dene Tha’ First Nation and Mackenzie County.

The Court of King’s Bench of Alberta confirmed a consent order today, temporarily halting the County’s proposed use of heavy equipment to clear routes to Bistcho and Thurston Lakes. The agreement comes ahead of a larger lawsuit filed by Dene Tha’, which argues the Government of Alberta improperly transferred control of sections of a former oil and gas winter road without adequate consultation.

Dene Tha’ leadership says the agreement threatens Treaty rights, wildlife, and culturally significant lands. Chief Wilfred Hooka-Nooza welcomed the pause, calling Bistcho Lake a vital part of the Nation’s traditional way of life.

Mackenzie County, however, disputes the claims, saying it acted in good faith and followed all regulatory processes. The County maintains consultations were completed, approvals were granted, and the work focused on clearing existing trails for public access.

The situation now heads toward a full court hearing, where the legality of the land transfer—and future access to the roads will be decided.
